Regular Town Board Meeting of the Town Board of the Town of Van Buren, held at the Van Buren Town Hall, 7575 Van Buren Road, Baldwinsville, New York on May 20, 2008 at 7:30 pm.

Approve minutes of the 5/6/08 Regular Town Board meeting:
151-08-000      MOTION BY Mr. Dudzinski, seconded by Ms. Dickman, to approve the minutes of the 5/6/08 Regular Town Board meeting as published.

7:35 pm continued public hearing to consider zone change for Herman and Walters Road from Ind A to INP for construction of an asphalt plant:
Mr. Sykes said this hearing will remain open for comments.  He said no action will be taken until Onondaga County Planning Board comments are received.

Stormwater Management Annual Report presentation:
Mr. Dave Hanney from Barton & Loguidice was present to address the Board.  He said 2007 was the 5th and final year of the town’s permit.  He said during that time two new laws were passed in the town, a stormwater management law that gives the town the responsibility to implement NYS construction stormwater permits and an illicit discharge and detection law.

He said a municipal pollution prevention plan was implemented for all departments.  He said an illicit discharge detection plan and an outfall inspection plan are in place.  He said a construction site manual has been compiled and he said they have been under budget for the last five years of work.  He said they will be having training at Barton & Loguidice on Thursday from Noon to 1:00 pm to go over the new MS4 permit.

He said the town will need to map all drainage to each stormwater outfall and will need to develop a watershed map.  He said 20% of the outfalls will be inspected each year. The town will have to sign off on all plans for construction permits before they are issued from New York State.  

Ms. Sabin asked how this affects the Codes Office.  Mr. Sykes said inspections need to be done but they can often be done at the same time they are there for other inspections.  He said the town may need to contract out some work depending on the number of subdivision applications that are submitted.

Mr. Sykes said the Central New York Regional Planning Board has helped the towns on a lot of the program implementation.

SEQR for Spano asphalt zone change:
Mr. Sykes said they will not act on this until after County Planning Board comments are received.

Ms. Dickman said it is important to note that this area is already zoned Industrial and what they are asking for is an overlay district.  She said this type of development requires more review than other industrial uses that would be allowed.

Participation in the Onondaga County multi-jurisdictional hazard mitigation plan:
Mr. Sykes said by joining this, the town will act together with other agencies working as a consortium rather than each town developing their own plan.
152-08-034      MOTION BY Ms. Sabin, seconded by Mr. Tupper, to name the Supervisor as the contact person and authorize him to sign the contract to participate in the Onondaga County multi-jurisdictional hazard mitigation plan.

Consider change in hours of operation of Town Hall and Court from 8:30 am to 4:30 pm through September 30, 2008 effective 6/2/08:
Mr. Sykes said all departments have been keeping logs and in 5 months eleven people came into the Clerk’s office after 4:30 pm.  
153-08-038      MOTION BY Mr. Johnson, seconded by Ms. Dickman, to change the hours of operation of Town Hall and Court from 8:30 am to 4:30 pm though September 30, 2008, effective June 2, 2008.

Mr. Sykes said this will bring the town into conformance with nearly every other town.  Mr. Sykes said if residents require access to departments after these hours accommodations can be made. He said there is a lot of information online as well.

Budget Transfers: None

Committee Reports:
Mr. Dudzinski said the Park & Recreation summer brochure is available.  He said the Fishing Derby was well attended.

Mr. Johnson said the Highway Department’s 1998 Chevy truck went for $1,300.00 at the auction and the box sold for $1,600.00. The total to the town after the commission is $2,610.00.

Mr. Johnson said they will be applying slurry seal to Village Blvd North and South starting next week and there will be some traffic slowdowns.  They will be starting Connors Road and the new park road the first week in June.

Ms. Dickman said the Insurance committee is reviewing quotes and comparisons of carrier and plan options.  She said they are making sure that anything that is proposed is equal to or better than that what the town is offering now.  

Mr. Tupper said the Planning and Zoning committee has finalized a draft on windmills and has given it to the attorney for review.  He said they also have other code changes available for review and he would like to discuss them at the next meeting.

Ms. Sabin said the Economic Development committee has turned over the solicitation of a franchise restaurant to a private developer because of the type and scope of information they require.

Highway Superintendent Comments: None

Supervisor Comments:
Mr. Sykes said that the new DOT regulations passed by the state in order to keep trucks on the Thruway will apply town our town roads and should decrease local truck traffic.

Mr. Sykes said the Assessor met with 240 property owners and 18 have signed up for Grievance Day, which is lower than normal.

Ms. Dickman said anyone wishing to file Grievance Day paperwork should go to the Assessor’s office soon and get an appointment with the Board of Assessment Review.

Mr. Sykes said the Baldwinsville Fire Department has pulled their building permit and will be starting work on the Crego Road firehouse.

Mr. Sykes said that Onondaga County has filed suit against the Manlius and Pompey Fire Departments from the fire in 2002 in which two firemen died.  He said a government agency suing a volunteer department is a bad precedent.  He said it is hard enough to find volunteers and for the taxpayers to fund the departments and he would hate to see us lose our volunteer departments in favor of a paid force.

Mr. Sykes said the recent Carp Tournament was a success with the anglers catching 36,000 pounds throughout the event.

Mr. Sykes said the Memorial Day parade is May 30th and he will contact the American Legion and VFW to disburse parade money.

Board Comments:
Ms. Sabin said the feedback the Economic Development committee is receiving is that developers want to be able to construct higher signs than our code allows.  She said this is especially true along the Thruway and said the town may have to work with the Thruway Authority and Senator DeFrancisco’s office to help them.

Mr. Johnson said if the State wants to keep tractor trailers on the Thruway rather than local roads they need to lower the tolls.

Engineer Comments:
Mr. Billings said the next round of Environmental Protection grants are coming up and the town has a few projects that may be eligible.  He said he will put together a list of recommended projects for the Board to consider and they are due June 30th.

Ms. Dickman thanked Mr. Billings for following up on the swale disturbance on Fisherman’s Creek Road.
