PLEASE TAKE NOTICE that the Town Board of the Town of Van Buren, Onondaga County, New York at a regular meeting thereof, held on October 18, 2005, duly adopted the following resolution, subject to permissive referendum:

RESOLUTION AND
of the ORDER ESTABLISHING
DISTRICT
Establishment of the HARBOUR HEIGHTS
LIGHTING DISTRICT, in the Town of Van
Buren, County of Onondaga, State of New York,
pursuant to Article 12-A of the Town Law.

WHEREAS, a map, plan and report have been prepared by Barton & Loguidice, P.C., licensed professional engineers of the State of New York, in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Van Buren, New York, relating to the establishment of a proposed lighting district, to be known and designated as the Harbour Heights Lighting District of the Town of Van Buren, and
WHEREAS, such map, plan and report have been duly filed in the office of the Town Clerk of the Town of Van Buren, New York, in accordance with the requirements of Article 12-A of the Town Law, and
WHEREAS, the boundaries of the proposed district are set forth in Exhibit A, attached hereto and made a part hereof, and
WHEREAS, an order was duly adopted by this Town Board on September 20, 2005, reciting the filing of said map, plan and report, the improvements proposed, the boundaries of the proposed district, the proposed method of financing, the fact the map, plan and report describing the same were on file in the Town Clerk’s Office for public inspection, and stating all other matters required by law to be stated, and specifying October 4, 2005 as the date, at 7:35 p.m. on said day as the time, at the Town Hall, 7575 Van Buren Road, Baldwinsville, New York as the place where this Town Board would meet and consider said map, plan and report, and to hear all persons interested in the subject thereof, concerning the same, and to take such action thereon as is required or authorized by law;
and
WHEREAS, such order was duly published and posted as required by law; and
WHEREAS, a hearing on said matter was duly held by said Town Board on October 4, 2005 at 7:35 p.m. on said day, in the Town Hall, 7575 Van Buren Road,
New York, at which all interested persons desiring to be heard were heard, including those in favor of, and those opposed to, the establishment of said Harbour Heights Lighting District; now, therefore, upon the evidence adduced at such public hearing, be it
RESOLVED AND DETERMINED:
a. That following due deliberation thereon, this Town Board, as the sole involved agency, hereby finds that this is an unlisted action which will have no significant adverse impacts upon the environment.
b. That the notice of hearing was published and posted as required by law, and is otherwise sufficient;
c. That all property and property owners within the proposed district are benefited thereby;
d. That all property and property owners benefited are included within the limits of the proposed district;
e. That it is in the public interest to establish said district; and be it further
RESOLVED AND DETERMINED:
That the establishment of the proposed lighting district as set forth in said map, plan and report, be approved, and that there be and hereby is formed and constituted the Harbour Heights Lighting District of the Town of Van Buren, which shall be bounded and described as set forth on Exhibit A attached hereto and made a part hereof; and it is
FURTHER RESOLVED, that the costs of formation of said lighting district shall be borne entirely by the developer of the Harbour Heights residential subdivision, and the costs of operation and maintenance of said lighting district shall be borne by the properties benefited thereby, said costs to be assessed on an ad valorem basis, and it is
FURTHER RESOLVED, that this order and resolution is adopted subject to permissive referendum as provided in section 209-e of the Town Law.

All that tract or parcel of land situate in the Town of Van Buren, County of Onondaga and State of New York, being part of Farm Lot 5 in said Town, being part of lands conveyed by Harbour Heights Associates LLC to Eldan Homes, Inc. by deed recorded in Onondaga County Clerk’s Office in Book 4773 of Deeds at Page 531, and being more particularly described as follows:
Beginning at a point in the easterly boundary of said Farm Lot 5, said point being N 7° 15’ 01” E, a distance of 550.00 feet, measured along said Farm Lot line, from its intersection with the centerline of NYS Route 31, said point also being the southeasterly corner of Parcel I as described in the above mentioned deed to Eldan Homes, Inc.; running thence N 83° 05’ 18” W along the southerly boundary of said lands, a distance of 570.00 feet to a point in the easterly boundary of Southgate
